The challenge of exporting to the US, a disappointing update
To our customers in the United States,
We are very sorry to let you know that, at present, we are unable to send our new Rich and Warming Hand Cream to the USA.
Some years ago, another company in the United States began trading under the same name as ours, despite us having established it earlier. Around ten years ago, they issued us with a cease and desist notice preventing us from trading in the US, and they have since registered the name in the UK as well. This has been both upsetting and costly to challenge, and we have taken legal advice on the matter.
Unfortunately, we cannot send goods to the US using our current labelling, as doing so could expose us to legal action. In order to make shipping possible, we would need to:
• change our trading name
• have the cream reassessed under the new name
• obtain regulatory assessment in the United States, which is significantly more expensive
• manage the added complexities of international postage, export requirements, and duties
After careful consideration, we have reluctantly concluded that sending products to the USA is not currently feasible. What we all need is someone who would be interested in making it under license in the US!
We are truly sorry that we cannot offer a solution at this time, and we sincerely appreciate the interest and support from those who have enquired.
